What process do i need to take to become a legal resident after marrying a us citizen?
what forms do i need to fill out?
I am in love with my fiancee we’ve been together 5 years, he’s a US citizen.
Last year I was in the US with my Optional practical training visa and i was able to get it because i graduated from a college in this country,
My fiancee and I want to get married, and i was just wondering how long it would take for me to get a green card after I marry him so i can work?
My OPT ended in at the end of December 2008, we wanted to get married soon so i didn’t have to go back to my country and leave him here, but for many reasons i had to go back to Mexico and stayed there for almost 2 months. I got back in the US February 14th 2009 and i entered the country with my tourist visa. If we get married, fill out and send all this forms below will things work out? or will they deny me because i entered the country as a tourist?
Is it possible for me to wait for the change of status while being in the US or would i have to go back to my country while everything is in process?
Any info will be greatly appreciated, and I thank you very much before hand!
are these steps correct?
- Get married
- Once married and i have the marriage certificate in hand my husband files the following forms:
* I-130
* G-235A
* I-864
- I file the following forms:
* I-485
* I-765
* I-131
* G-325A
and Send all in one envelope?
If an immigrant wants to go to back to Mexico in his own car (he has title) will he have any legal problems?
I have a friend, he is not a legal citizen. He wants to go back to Mexico drving his car. He has the title for his car. Will he have a problem crossing the border with his car.
Which one is your legal name?
The one on your birth certificate?
or
The one on your marriage certificate?
or
The one on your SS Card?
or
The one on your greencard?
How can you prove it? Is there a law about this?
=====
For example:
1. You were born in the Philippines, and you are now a US Immigrant. The name on your birth certificate is:
First Name: Melody
Middle Name: Torres
Last Name: Peralta
2. You married a US Citizen. Your name changed to:
First Name: Melody
Middle Name: Peralta
Last Name: Perry
3. You applied for an updated SS name. SS issues you a new card under your married name: Melody Peralta Perry
4. You applied for a new State ID card under the married name as well.
4. Your greencard is expiring so you applied to renew it. When filling up the I-90 you used your maiden name which is the name on the expiring original greencard. You sent it to USCIS and you didn’t make a copy of the application.
5. USCIS sends you an ASC Appointment under the name May Peralta. When you got to the ASC Appointment, Picture Taking/Fingerprinting – you asked to change the name on the updated greencard to your married name which is reflected on your SS Card, State ID, & Marriage Certificate. USCIS says no we cannot do that. That they understand it’s the way people do it in the Philippines but they cannot do it here like that. They said the name on the greencard will be Melody T. Perry. You asked if it would ever affect anything when you file a citizhip, and she said just explain and tell them what I told you. Trusting USCIS knows what they are doing and saying, you said ok. You got the renewed greencard with the name Melody T. Perry
6. Your state ID expired and need to renew it. You went to DMV to renew it. DMV will NOT renew because the name on the SS card and Green Card are not the same. That you should go to SS and get another card that matches the name on your greencard.
7. You go to SS office – they told you we cannot issue you that name because USCIS has not updated your name in the system. That you need to go to USCIS to have them update the name on the system.
8. When you went to USCIS you were told to fill up the I-90 to correct the mistake and pay if I wanted to change the name on your greencard. You explain that it wasn’t the name you applied for originally because you asked it to be changed to your married and name and they didn’t. (see explanation on #5) The USCIS representative kept pressing that you MUST apply for a new greencard and you need to pay for it.
9. You are convinced it was an administrative error so you went and filed another I-90. You sent them a registered mail with explanation and coipes of the evidences, and the original greencard. Because that’s what you thought is the right thing to do, and what you understood from what you’ve read in the form ( ) which states it should be sent to the Service Center that issued it. You got the address from the receipt sent to you, stating where to for the Fingerprinting.
10. Two months later you get an appointment with USCIS to pickup a greencard. A man comes out talks to you why you sent this documents to this particular. He gives you all the documents you sent.You say it’s all explained there. He said you sent it to the wrong address. I said ok can you give me the right address then? He kept talking and stressing that he’s trying to help me not pay for another greencard (I forgot to get that address) so he will put Perry in their system to update your name it – that after you are on your own. I asked for a phone number and a name to follow up about it. He said you are talking to the wrong person. He gives you an initial of his name and you forgot what his last name is, because he took the appointment paper that had his name. He said, "Give me your number and I will call you in two weeks". (The receptionist chuckled and told me that even her, she works there and she doesn’t know where to get ahold of him when he needs him). This guy also expressed how SS always throws their job to them. They’re the ones who should follow USCIS.
11. Months passed this USCIS rep didn’t call you, no voicemail message at all. So you try to call USCIS hotline and you just never could get ahold of them any day, any time!
12. You called SS to ask if they could verify that USCIS already updated your name in the system. SS says no, they cannot look at that record. You explain everything you’ve been through. SS rep says, USCIS need to correct the name on the greencard because it is a wrong name.
13. You are torn between them and not sure what else to do next. You are separated, have three kids you cart everytime to get to these offices. You have no car, you have no money to pay the taxi. Your ex husband isn’t reliable either – he can’t miss work. Your so called friends are never available because they are busy with their own lives. You cannot apply for a job because you know it will be an issue as well. You don’t know if you should jus
just apply for citizenship (even if you found a loan) but you’re afraid it will also bounce back and you will lose hundreds of dollars you CANNOT refund if it doesn’t get approve for the same ID issues.
14. What would you do? What do you need to know? Who to go to for issues like this? Are there any resources, book of laws that could possibly help?
15. You want to go to USCIS but don’t know what else to say. You have no money to pay for another greencard and even if you do, you feel bad paying because you know it wasn’t your fault. They seem to manipulate and put words in your mouth. I am tired and frustrated.
What if I apply for a greencard with the correct name and when I get there – they will tell me I cannot have my complete married name and put the same old name again?! I am not sure if I am upset with myself for being gullible or maybe irresponsible in not making a photocopy of the first application I sent to them to renew my greencard. Or if I should get upset with people in USCIS. Or maybe I am upset with both. I just want an effective solution, I hope someone can help. I am so sick and weak right now I am sorry if I typed anything harsh.
I want to become an illegal alien, who do i have to contact? Senator Feinstein wont answer me.?
Dear Senator Feinstein,
As a Californian and excellent customer of the Internal Revenue Service, I
am writing to ask for your assistance. I have contacted the Immigration and
Naturalization Service in an effort to determine the process for becoming an
illegal alien and they referred me to you.
My reasons for wishing to change my status from U.S. Citizen to illegal
alien stem from the bill which was recently passed by your Senate, in which
you voted in favor of. If my understanding of this bill’s provisions are
accurate, as an illegal alien who has been in the United States for five
years, what I need to do to become a citizen is to pay a ,000 fine and
income taxes for three of the last five years. I know a good deal when I see
one and I am anxious to get this process started before everyone figures it
out. Simply put, those of us who have been here legally have had to pay
taxes every year, so I’m excited about the prospect of avoiding two years of
taxes in return for paying a ,000 fine. Is there any way that I can apply
to be illegal retroactively? This would yield an excellent result for me and
my family because we paid heavy taxes in 2004 and 2005.
Another benefit in gaining illegal status would be that my daughter would
receive preferential treatment relative to her law school applications and
most likely get a scholarship to the University and save me a fortune. Also,
as you know healthcare benefits are costly, my insurance alone costs me over
,200 per month and thats if no one even uses it. As soon as my legal
status changes, my hospital bills will be sent to the taxpayer and this will
save me a lot of money as well.
If you would provide me with an outline of the process to become an illegal
citizen and copies of the necessary forms, I would be most appreciative.
Thank you for your assistance in helping me with this important transition.
Your Loyal Constituent,
I was kicked out of a public library for listing items on E-bay. Is this legal?
I was asked to leave my local library earlier today because I was using the computer to sell items on e-bay. The last I knew the library was open to the public and certainly intended for use by upstanding tax paying citizens such as myself.
To make matters worse, it took about 20 minutes to transport all the items from my truck to the PC area of the library. I carried in 2 full hampers of clothing, 4 aluminum rims for a 1993 Firebird and an old desk – all which I intended to list / sell on E-bay. No sooner did I get 2 items of clothing pictured, description listed and auction posted when the librarian told me I could not sell items on E-bay from the library.
Aside form a rude tone; this librarian demanded I gather my belongings and leave. I asked for an explanation but the only answer I got was “you can’t sell items oh E-bay here”. So my question is – what did I do wrong? I’m a tax paying citizen entitled you use the public library and it’s PCs.
