What is a Last Will and Testament?

A last will and testament is a legal document that states who your property is distributed to when the time comes, chooses an executor who will manage your estate until your assets are completely distributed, names a guardian for any minor children and sets up trusts for your children if you choose to do so.

Why Not Some Other Estate Planning Tools?

If you have a large estate, then it would be better to create an extensive estate plan. If you do not have a lot of assets, preparing last will and testament forms are all you will need for now then you can create an extensive estate plan later in your life when circumstances change.

Why Should I Get A Last Will if My Estate Does Not Have any Value?

If you were to meet your fate by an accident, through an untimely natural cause or by the negligence of someone else, your beneficiaries could receive a substantial sum through the proceeds of a life insurance claim or lawsuit. Without a will, the distribution would go through probate and your beneficiaries would receive much less after a lengthy court process.

In most states, the probate court will first appoint an administrator who will have to post a bond from available cash in the estate or proceeds from the sale of some of the assets in the estate. Because there is no will listing beneficiaries, the courts will distribute the remaining assets according to state law and leave less for your family than you would have wished. You should prepare at the very least a last will to avoid probate.

Do I Need A Lawyer?

There are no legal requirements you have to hire a lawyer to execute your will and there are many resources available that will allow you to prepare your own last will and testament forms. Your situation will dictate if you need a lawyer to prepare last will and testament forms for you.

In normal situations, an attorney will simply enter the relevant names into the proper places on the last will and testament form and then makes sure you sign the document. A high paid attorney is not needed for this simple task and in normal situations, you can save money and prepare your own last will.

Only in unusual circumstances will you need an attorney to prepare last will and testament forms such as: forseen difficulty in distribution of your property, leaving your spouse out of your will, you have an estate of high value or anything else that you deem to be unusual.

My mom is a widow with six grown children and several grandchildren. She wants me to find a form for free, if possible.
I know it’s hard for most people to believe, but whatever Mom decides will be fine with all of us. My Dad made the mistake of making a will through a lawyer over thirty years ago (my parents were divorced), and we knew my Dad had at least $11,000 in one account alone. He had four accounts. When his lawyers got through wasting time (no matter how we tried to hurry them), most of the money and property, which we estimated to be worth $55,000 (a conservative figure), was eaten up in lawyer “fees”.

Dad’s executor was too ill to participate, so the lawyers had a field day. We children got less than $300 each.

My mom remembers that, and she regrets to this day what the lawyers did to her children when we were too young and grieved to do anything about it.

She will fill out the DIY papers, then have a lawyer in the family (her brother’s child) to look over it and make suggestions. This has always worked for us in any legal matter (we’ve had several!) since Dad’s death.

I heard if one wrote their will & sent it certified mail to themself, left it sealed until their death,that it would be considered a legal document. Is this true?

ok, I have windows xp if i’m not mistaking, i have a few viruses, and some kind of total security popped up, and its unregistered, and says there are trojans and spyware, and worms, and it wants to to register to fix it, when i go to download a spybot or anything to get rid of the spyware, it will run the download, then stop/freeze at the last second. I dont know what to do.

My mortgage has been owned by 3 different lenders last year. Will I get 1099 forms from each one, or only one?

Bank of America now holds the mortgage but they are the 3rd one to own it and will most likely keep it for the rest of the 30 year note. However, will I get 1099 forms from the other 2 lenders or is it all transferred to Bank of America?
